The third time was a charm for prosecutors who were able to get a conviction of Dalia Dippolito last week, but defense attorneys for the Boynton Beach woman who hired an undercover cop to kill her husband have filed a motion for a new trial.
They claim a juror was sleeping during critical testimony during Dippolito's third trial.
She was found guilty back in 2011, but that was overturned and a mistrial was declared in her second trial back in December.
If this conviction holds, Dippolito will be sentenced next month and faces up to 20 years in prison.
