Former Vice President Mike Pence has been issued a subpoena by the special counsel investigating the efforts of former President Donald Trump and his allies to overturn the results of the 2020 presidential election.

The subpoena was issued after months of negotiations between Pence's lawyers and Special Counsel Jack Smith.

According to ABC NewsSmith requested documents and testimony relating to the efforts to undermine the election and the riot at the U.S. Capitol on January 6, 2021, when Congress was meeting in a joint session to certify the results.

Smith was named special counsel by Attorney General Merrick Garland in November and was tasked with overseeing the investigation of the 2020 election and the investigation into classified documents found at Trump's Mar-a-Lago home after he left office.

Pence has not commented on the subpoena, and it is unclear if he will cooperate or invoke executive privilege.

Both the Justice Department and the special counsel's office refused to comment.
