A Constitutional Crisis in The Making & Elon Musk is Saving You $11 a Day – Top 3 Takeaways – February 11th, 2025
- A constitutional crisis in the making. I’ll start by saying that I believe that President Trump, Elon Musk and the rule of law will win in the end. Just as was commonly the case in Trump’s first administration, Democrats and varying forms of swamp creatures, are suing the Trump administration for just about everything it does everyday to keep the status quo corruption of the federal government in place. This is no surprise. It’s also no surprise that there are judges who can be found to assist in at least temporarily blocking progress being brought about by team Trump and team DOGE as we’ve seen. This is endemic of what we’d previously seen as these same actors sued the Trump administration to try to stop construction of the southern border wall, and lost, but they were successful in delaying Trump’s start for the construction of the border wall by 2.5 years which was why he wasn’t able to have it finished within his first term. Ditto the Trump administration's withholding of federal funds from sanctuary cities. Team Trump won but not until the final year of his presidency. This time around not only have we seen President Trump work at a record pace since becoming president, but we’ve also seen lawsuits coming at his administration at a record pace. Donald Trump wasn’t even president of the United States for a full hour before the first lawsuit had been filed against his administration – that one for the very creation of DOGE. By my count there are ten current legal challenges to Trump’s executive actions. That’s an average of one every other day. As of Monday, three of the challenges had been successful in slowing down the Trump agenda. The first, an injunction against Trump’s order ending birthright citizenship unless at least one parent was legally residing within the United States. The second, the Trump administration's deferred resignation program which offered 2 million federal government workers (2/3rds of the workforce) full pay and benefits through September 30th if they’d agree to resign by last Thursday. The third, DOGE’s ability to access 90% of federal spending by the Treasury Department. The reason why my top takeaway today speaks of a potential constitutional crisis in the making is this. The President of the United States is the executive branch of the United States. Everyone within it works for him. This is no different than a CEO of company. Now imagine for a moment if the CEO of a company wasn’t allowed to make hiring and firing decisions. Imagine if they also weren’t allowed to seek an audit of their company’s financials. The concept is absurd in the context of a corporation, it’s unconstitutional in the context of the federal government. The birthright citizenship decision is an entirely different ball of wax, however the ability to hire, fire or offer buyouts as the case may be is without question within the president’s authority. So is the ability to direct a task force to engage in forensic accounting. What’s different with the legal challenges this time around, that have proven to be early roadblocks for team Trump, is that they aren’t just seeking to stop Trump’s agenda, they’re seeking to undermine his constitutional authority. This is why the activism by the left and their judges this time arrives at the level of a constitutional crisis if it is allowed to stand – or even to delay. And that’s exactly where we are today as Monday’s hearing to consider the “legality” of the offered buyouts resulted in...nothing. The Clinton-appointed judge left the stay on the buyout offer in place while he considers how he’ll rule – which he’s provided no timeline for doing. Constitutional law isn’t on the left’s side so now they’ll stall. The reason the left has become so desperate is because...
- DOGE has been incredibly effective. How many wasteful government programs have been cut thus far? How much money do you think Elon Musk’s DOGE has saved you so far? The answer is that as of Monday, after only 21 days, DOGE’s transparency had led to a total of 48 government programs being eliminated for a total savings of $36.7 billion. What does that mean to you? It means DOGE has already saved every taxpayer $244.89, or in other words, through his first three weeks on the job, Elon Musk has been saving you $11.66 per day. If DOGE was able to keep cutting at it’s current pace that would be $638 billion annualized or in other words, a taxpayer burden that would be $4,258 less for you and me. Now I’ll run out on a limb by guessing that you’d rather pay $4,258 less in taxes as opposed to paying for transgendered Peruvian comic book heroes, for example. But that’s not all that DOGE’s current pace of cost cutting could do. There’s the potential to...
- DOGE our way out of deficits. The average federal deficit for President Biden’s four years was a staggering $1.9 trillion – which was almost exactly what last year’s deficit turned out to be. Hence why Elon Musk in part identified $2 trillion in savings as a goal for DOGE out of the gate. The bottom line is that we must restore fiscal restraint and begin to balance our budget before it’s too late. According to the most recent estimates, for the first time on record, paying interest to service the national debt has exceeded defense spending this year, making debt service the third biggest expenditure behind Social Security and Medicare. However, consider this. The annual deficit averaged $810 billion during Trump’s first three pre-COVID years. If DOGE were able to continue to cut costs at their current pace until July 4th of 2026 –when DOGE’s work is scheduled to be done, they’d achieve $957 billion in annual savings. A total that would more than enough to cover a typical Trump administration deficit. The last year we didn’t run a federal deficit was 2001. If DOGE is allowed to do it’s job, it’s possible that could happen before Trump’s second term is done – which would save you a ton in taxes over the long run.
