Takeaway #1: Could Team Jack Smith Be Charged with a Florida Felony? 

The most interesting news that broke involving a prominent female political player yesterday didn’t involve Hillary Clinton. I’m willing to believe her assertion that “she doesn’t recall ever encountering Jeffrey Epstein”, after all Hillary wasn’t Jeffrey’s type – and honestly how often since January 20th, of 2001 do you think Bill and Hillary Clinton have been in the same place? As an aside I do also agree on this statement from Hillary to the House Oversight Committee yesterday: A committee endeavoring to stop human trafficking would seek to understand what specific steps are needed to fix a system that allowed Epstein to get away with his crimes in 2008. That’s true! The sweetheart deal that essentially let Epstein off the hook in Palm Beach County way back when, not only was an affront to justice for Epstein’s victims up to that point – it created countless other future Epstein victims in the years to come! Hillary Clinton is right about this. But, no, nothing meaningful was ever going to come out of her testimony yesterday – however the Susie Wiles revelation was really something. On the surface the Susie Wilies news that hit yesterday may seem like one of those stories that really doesn’t matter to you and perhaps is old news. In case you missed it the news hit that during Jack Smith’s witch hunt to attempt to takeout President Trump it’s now well known that he egregiously subpoenaed phone records of a myriad of conservatives including numerous Republicans. But what was new that’s dropped is this...Team Smith spied, potentially illegally, on a phone call by fellow-Floridian and now White House Chief of Susie Wiles. As we’ve learned in 2023, the FBI recorded a phone call between Susie Wiles and her attorney. Her attorney consented to the recording, Susie did not and was not aware. First of all – for this remarkable violation of client confidentiality – that attorney should be disbarred. Most of all though – that act by the FBI may well have been a felony offense. Under Florida’s Security of Communications Act...  

Takeaway #2: Florida requires the prior consent of all parties  

...to the communication before any person can legally intercept or record a wire, oral, or electronic communication (this includes phone calls). Recording without that full consent is a third-degree felony, punishable by up to 5 years in prison and fines. There is an explicit exception in the statute that applies to law enforcement...it is this... It is lawful for an investigative or law enforcement officer or a person acting under the direction of an investigative or law enforcement officer to intercept a wire, oral, or electronic communication when such person is a party to the communication or one of the parties to the communication has given prior consent to such interception and the purpose of such interception is to obtain evidence of a criminal act. This allows one-party consent (the consenting party could be an informant, cooperating witness, or even an undercover agent who is a party to the call) when the recording is for the purpose of gathering evidence of a crime. But here’s a key in this context. Susie Wiles was never implicated in any wrong doing. Susie was never indicted. Therefore, the rights of Susie Wiles under Florida law appear to have been violated by team Smith. And here’s the thing. Getting real accountability in Washington D.C. may be like pulling teeth. Getting accountability in the Free State of Florida is a very real thing. I’ve contacted AG James Uthmeier about this... For those who’ve wanted accountability for the abuses of Jack Smith. This revelation may provide an opportunity for it.  

Takeaway #3: Four Year Low Mortgage Rates  

Fixing the affordability issues brought about by 40+ year high ‘Bidenflation isn’t done in a day and can’t be completely fixed within a year. High inflation is inherently insidious because once it's occurred it doesn’t reverse. Literally, the only way to reverse inflation is through net deflation which can’t be done without creating an economic crisis through deflating asset values. However, inflation rates can be brought back down so that the average person can once again earn more than what the rate of inflation is and begin to get ahead again. That’s exactly what happened in year one of Trump 2.0 as the rate of inflation fell and wages rose leading to real incomes (net of inflation) rising by nearly 1% (after negative real income rates during the four years of Joe Biden). And yesterday we reached another milestone on the way to lower inflation and greater affordability, sub-6% mortgage rates. For the first time in nearly four years, a 30-year fixed rate mortgage has averaged under a 6% rate over the last week. That hasn’t happened since September of 2022. Should inflation continue to track lower, and the Federal Reserve continue to drop rates lower (a big “if” with “Too Late” Jerome Powell and company in place). The housing market that’s been disrupted for years, due to many people feeling trapped in their current property due to a low fixed mortgage rate that might double or triple if they were to move, could begin to normalize again. That would be a win-win and the biggest of all to address the biggest affordability challenge of them all. Especially with affordability housing increasingly going to Americans once again as opposed to being taken up by illegal immigrants.
